FMCSA suspends enforcement on 34 hour restart rule.

The 34 hour limitations imposed by DOT under their Final Ruling released on July 31, 2013 has been suspended until a determination on the ramifications of a Naturalistic Study has been made.

The 34 hour restart ruling, a part of the new Federal DOT Mandates, has been one of two points of contention fought by the Transportation Industry.  Under the new ruling, a driver was limited to a single 34 hour restart every 168 hours.  Further, the 34 hour restart must have fallen over two (2) consecutive 1am-5am time periods.  After points raised by the Transportation Industry, FMCSA has decided to suspend the ruling on the 34 hour restart and revert to the old ruling which allows a driver to utilize a 34 hour restart whenever necessary without any further impositions.

This determination for permanent suspension could come as early as the end of the fiscal year 2015 (September 30) at which time, DOT will release their findings and may or may not reinstate the 34 hour limitations at that time.
